The Company provides a chauffeur-driven vehicle travel service that operates exclusively on reservation, connecting customers and independent vehicle drivers (hereinafter the "Service").



These General Terms and Conditions constitute the contract by which the Company offers and insures the Service. These apply for orders of vehicles placed by the Customer to the Company by telephone, or Internet at www.sdtransferts.fr or Apps developed by the Company.


By using the Service, the customer acknowledges and accepts all of these Terms and Conditions.


1. PURPOSE OF THE SERVICE


The Company connects its customers with independent partners operating a chauffeurdriven car for private transfers or with larger vehicles for groups. The Company is subject to the provisions of Articles L. 3122-5 of the Transport Code.


2. ORDER A VEHICLE



The Customer is informed that, in Paris Region, three models of vehicles are available: the "Sedan" service can support up to 3 people and three pieces of luggage of about 22 liters, the "minivan" service up to 4 passengers and 5 suitcases. The "Van" can carry up to 8 passengers and has a large trunk volume. 
All vehicles offered are in compliance with the standards of the VTC legislation and are of varied models. The Company will be able to offer vehicles adapted for people with reduced mobility from 2020.


The service is open every day, 24 hours a day, and can only be accessed by reservation, in advance or immediately.


2.1 Immediate order


The Customer will indicate all the particularities of the route: the point of departure, the possible intermediate stages, and the final point of arrival, as well as the first and last name of the passenger on who’s name is the reservation ( hereinafter the "Passenger").


Upon receipt of the order, the Company will search for available vehicles in the requested area. If a vehicle is available, the Company propose the Customer an estimated waiting time for the arrival of the vehicle at the indicated starting point, as well as the cost of the journey ordered.


Once the order has been validated, a booking number is assigned to the Customer. This number must be kept and communicated to the Company for any modification or cancellation.


The Customer is informed by e-mail of the confirmation of the orders made by internet, and by SMS for those made by telephone.




2.2 Reservations in advance



The Customer may order a vehicle before the date and time of departure. The order can be confirmed from 1 month up to 30 minutes before the scheduled departure time.


The Client will indicate the date, time and place of departure, the possible intermediate stages and the final point of arrival, the other possible features of the transfer (additional indications for the place of meeting, etc.), as well as the names and surnames of the Passenger.


Depending on the number of orders already registered, the Company reserves the right to refuse additional advance orders.


The Company registers the order and starts the search for the vehicle one hour before the departure time.




2.3 Pick up from an airport


When ordering, the Customer must specify the airport, the date of the transfer, and the flight number.
The planned landing time and the arrival terminal, which may be modified by the flight conditions and the airport authority, may be filled in but are not contractual.


The responsibility of the company cannot be engaged in case of erroneous information indicated by the Customer (incomplete flight number, date error), or in case of erroneous information relating to the reference flight given at the airport.


2.4 Telephone order


Telephone ordering service is available 24 hours a day and 7 days a week (cost of a local call from a landline when calling from France and of an International call when calling from other countries.).


The cost of the reservation by phone is 2,00 € TTC. This order management fee is included in the price of the transfer.


The order is payable by credit card during the phone call, or any other means of payment disposed by the Company.


2.5 Order online (website, mobile internet)



The Customer can place an order online, via the website www.sdtransferts.fr, mobile Internet or through dedicated software applications.


Online Order results in an immediate debit of the credit card registered by the Customer when ordering. No additional charges are levied by the Company on the price of the transfer, except for additional costs in case the driver has to wait the Passenger more than 10 minutes driver at the point of departure.


2.6 Modification and cancellation of the order



The Customer may cancel the order placed by telephone, via the Internet via the "www.sdtransferts.fr" website, or by means of a software application provided by the Company. 


Any cancellation is charged to the customer:


 If the cancellation is made 20 minutes after the confirmation of the order, the total amount of the transfer will be billed in its entirety with a minimum of 20 € TTC.


3. PAYMENT


The credit card will be debited at the time of ordering the transfer.










During the route, the Customer may ask for modifications. The Driver will indicate the price before confirming it.


The payment is made by secure electronic payment by credit card. The system developed by the Company allows secure transactions according to banking security standards with an encryption system. The security system blocks the bank details (credit card number, expiration date ...) provided by the Customer to any third party.


By providing his bank details, the Client agrees in advance and without condition, that the Company proceeds with the secure transaction. The Customer therefore authorizes in advance his bank to debit his account at the sight of records or statements transmitted by the Company.


4. PROCEDURE


The Passenger will receive an SMS of confirmation of arrival of the vehicle at the place of departure. The Passenger must come to the driver as soon as the vehicle arrives at the point of departure or at the agreed time when booking in advance.



In case of absence of the Passenger, the waiting time will not be charged during the first 10 minutes after the arrival of the vehicle at the departing point. After 10 minutes, waiting time is charged 2 € € per minute from the first minute of waiting


The absence of the passenger for 15 minutes will result in a cancellation without refund


5. OBLIGATIONS AND RESPONSIBILITY


The Service offered by the Company consists of the research for an available vehicle corresponding to the Customer's request. The Company is thus held to a simple obligation of means and will offer its best efforts to find a vehicle available for the Customer as soon as possible.


5.1 Insurance


The Company is guaranteed by a well-known and solvent insurance company that covers the risks related to its activity in accordance with the enforced legislation.


Passengers are considered as third parties vis-àvis the Driver, and are covered for all bodily, material and immaterial damage that they may suffer as a result of a traffic accident. This means an unlimited insurance for bodily injury , from the moment of depart until the descent of the vehicle, except for the damage caused by the passenger’s fault.


5.2 Availability of the service


The Company makes every effort to make online ordering services available on a virtually permanent basis. However, the Company may have to interrupt these services for operating or maintenance reasons.


The Company cannot guarantee the constant availability of the Service, the Internet portal or the SMS service. In particular, the Company cannot be held responsible in case of unavailability of the mobile network, Internet, operation of the mobile device of the Customer or the Passenger. The Company cannot either be held responsible for those material malfunctions or for non-availability, except if they result from gross negligence or intentional fault attributable to the Company.


In addition, the accessibility of the Service is conditioned by the Customer's use of sufficient and appropriate computer resources allowing access to the service, including Internet connection, appropriate Internet browser and compatible phone / smartphone. Advice to optimize access to the Service may be provided by the Company to the Client upon request of the latter.


5.3 Vehicle Availability and Transportation


The responsibility of the Company cannot be engaged in case of unavailability of vehicle.


However, if the delivery of the ordered vehicle could not be made within 30 minutes following the order of the Customer, the Company shall reimburse the Customer the full price received since the transfer is not performed and canceled due to the delay.


The responsibility of the Company cannot be engaged in case of force majeure (external, unpredictable event) and in particular in the following cases: failure or malfunction of the telecommunication networks (Internet, telephone), inaccessibility to the service of telephone or online reservation, unusual disturbances of the traffic (bad weather, traffic accident , etc.).


The Company uses independent drivers to carry out the transfers, and the performance of the transport service is under the sole responsibility of the Driver of the vehicle.



The responsibility of the Company cannot be engaged, in particular in case of delay because of the driver of the vehicle. Only the Driver is responsible for any damages resulting from the non-performance or improper performance of the transfer.

The Company and the Driver are not responsible if the Passenger must be accompanied by another person and that the latter is absent, neither if the accessibility to the vehicle is insufficient, if the vehicle cannot park on the public highway near the point of departure to pick up of the Passenger, or if for any reason beyond his control, the driver of the vehicle cannot pick up the Passenger.


The performance of the transport service, from the ascent to the descent of the vehicle, is under the exclusive responsibility of the Driver of the vehicle and the Passenger


Any request for special assistance from the Passenger, which exceeds the only transport of the Passenger, is the entire responsibility of the Passenger in case of accident or damage occurred in the course of this assistance.


5.4 Journey time


Estimated journey time communicated by the Company to the Customer when ordering is provided for information only. These journey times are calculated from standard durations, are not contractual and cannot engage the responsibility of the Company.


In the event of a trip of particular importance to the Customer or the Passenger, and / or subject to hourly constraints, it is up to the Customer to take a precautionary margin in terms of sufficient time to alleviate any difficulties related to traffic or other incident.


The Company recommends in particular to the Customer to provide an additional margin of 30 minutes when traveling to the stations and 45 minutes in case of airports in normal traffic conditions. The Company cannot be held for responsible for the consequences of traffic conditions.


5.5 Responsibility of the Client


The Customer agrees to behave properly inside the vehicle.


In the event of damage of the equipment or the vehicle attributable to the Customer, the Company will charge the cost of repairing the vehicle or changing the equipment.


Passengers, adults and children, are required to fasten their seatbelt. A fine is incurred by those caught in default by the police.


For safety reasons, smoking and transporting flammable, explosive, corrosive or toxic substances is prohibited. Failure to comply with this stipulation is the responsibility of the Customer and the Passenger. The Company reserves the right of recourse.


Baggage must be placed in the trunk of the vehicle. The luggage remains under the full responsibility of the Customer. The Driver may refuse to take care of baggage or to take those whose weight or dimensions are excessive, as well as those he deems to be detrimental to the safety of transport.


5.6 Restriction of access to the Service



The Company may restrict access to the Service to any Customer, without notice or limitation, especially in the following cases:
- When the client doesn’t comply with his obligations
- Inappropriate behavior of the Customer or companions on board
- The absence of payment by the Customer amounts to Safar Drivers
- Cancellation of the Order by the Customer after the assignment of the car, 3 times in a period of 1 month.


5.7 Foreign transfer Service


Company offers a service of connecting clients with all companies of transport. The Company, then, acts as a simple intermediary and cannot be held responsible for any damage or prejudice. Vehicle requests are made under the responsibility of the company transporting persons abroad.


6. COMPUTING AND PERSONAL DATA


6.1 Personal data


The information collected by the Company as part of the Service is subject to computer processing intended for the implementation of the Service, in particular the Customer's identification data as well as the information relating to the transport services ordered and performed. This information is necessary for the Company to process orders. In particular, they are recorded in the Company's customer files.


In order to optimize the efficiency of order management, the Company also reserves the option to record and keep information on calls received by its Call Center.
The Company undertakes to ensure the confidentiality of the personal data communicated by the Customer.
The Customer is informed that the Company may use the personal data concerning the Customer in order to send him/her commercial offers likely to interest him.


The Customer consents upon the registration of his email address to receive any newsletter sent by the Company. If the Customer no longer wishes to receive the mentioned information, he or she may unsubscribe at any time by clicking on the link provided for this purpose or by sending a written request to the given addresses.



In accordance with the law "Informatique et Libertés" of January 6, 1978, the Customer has the right to access, modify, rectify and delete personal data concerning him or her.

6.2 Statement of confidentiality and cookies


Safar Drivers collects and processes the personal information of users of the website and the application to provide you with an improved web service and personalized benefits.



The cookies used are: - Those which allow you to move around the site and use its basic features. - Functionality cookies are used to recognize you when you return to our site and allow us to offer you improved features. - Performance / analytics cookies allow us to recognize and count the number of visitors as well as collect information about the use of the site. - Targeting or advertising cookies record your visit to our site, as well as the pages you have viewed and the links you have followed. Les marques et logos présents sur le site Internet  www.sdtransferts.fr et les applications logicielles sont la propriété exclusive de la Société à l'exception des marques et logos de partenaires de la Société.


The trademarks and logos on the www.sdtransferts.fr website and the software applications are the exclusive property of the Company with the exception of the brands and logos of partners of the Company.


Any redistribution, reproduction, total or partial marketing of the content, in any form whatsoever, is strictly prohibited.


8. MODIFICATIONS


The Company reserves the right to modify these Terms and Conditions without notice.


9.APPLICABLE LAW - JURISDICTION



These Terms and Conditions are subject to French laws and regulations. In case of difficulty on the interpretation or the execution of the present General Conditions, of difficulty in the execution or the realization of one of the services ordered on line, any consumer natural person is free to seize the Court of his choice
